When Can Family Members Act as the Plaintiff?
If you have lost a loved one due to an accident caused by someone or something else, you could be entitled to compensation through a legal action known as a wrongful death claim. Under Georgia Code 51-4-2, when a person is killed as a result of a homicide or a wrongful death, then the surviving spouse, or if there is no surviving spouse, a child, or children may file suit to recover the value of the life of the decedent.
